Based on article 7, 8, 9 and 64.2 items (a) and (b) of Law on General Elections in Republic of Kosovo no 03/L-073 and Law no 03/L-256 on Amendment of Law no. 03/l-073 on General Elections in Republic of Kosovo and article 12 of Law for Local Elections in Republic of Kosovo no. 03/L-072, Central Election Commission on 02.07.2013 issues: ELECTION REGULATION No. 02 / 2013 DRAFTING, CONFIRMATION AND CHALLENGE OF VOTERS LIST Article 1 General Provisions This rule is intends to regulate drafting, confirmation and challenge of the voter lists, challenge and confirmation process, publication of voter lists and distribution, as well as the principles of personal data protection in the process. Article 2 Definitions 2.1 For purposes of this Regulation, the List of Voters (LV) means a list of all voters entitled to vote, as required by Article 7.1 of the Law on General Elections in the Republic of Kosovo. 2.2 Central Civil Register means the register of permanent residents, according to the Nationality Law and under the Law on General Elections. 2.3 Period of challenge and the confirmation means the period of time after the announcement of the election date by the President of Kosovo, in which voters can vote to oppose inaccuracies or omissions in the Voters List in certain countries by the CEC and in accordance with rules and procedures established by the CEC. Article 3 The process of drafting the Voters List 3.1 CEC maintains Voters List and ensures that the Voters List is accurate and a) Updated, and it contains: b) a) Extract the most recent available from the Central Civil Registry of all voters entitled to vote who are registered as citizens of Kosovo under the Law on Citizenship; c) b) All eligible voters to vote abroad who have successfully applied for voting abroad.. 3.2 Central Civil Registry CEC to provide all relevant information that the CEC requires maintaining the Voters List in accordance with the deadlines established by the CEC. 3.3 In order to create the list of voters, the CEC during the election process receives three (3) times the civil registry extract from the Civil Registry Agency. The first time, no later than two days after the announcement of the election date, second time not later than 3 days before the start of the challenge and confirmation from the voter lists, and the third time no later than two (2) days after the end of the challenge period and confirmation of VL. 3.4 Civil register extract must contain all registered citizens aged 18 years and above, including those who turn 18 until Election Day. The personal information that will be provided to each citizen are: name, surname, date of birth, his / her gender, parent's name, ID number, date of registry, municipalities, municipal civil registration centers, municipal code name, residence address, residence UD-code and P-code of residence. 3.5 The competent court shall submit data to the CEC for persons whose action ability of action has been deprived with final judicial decision. These data must be submitted as required by the CEC. CEC no later than ten (10) days before the start of the period of challenge and confirmation of VL, must request the Kosovo Judicial Council to submit a list of persons to whom the ability of action has been deprived by court. Personal data of these persons should include: name, surname, date of birth of his / her personal number and address 3.6. CEC before the start of the challenge and confirmation of VL, names of persons whose ability of action was deprived with a final court decision. 3.7 Voters List will include: a) All citizens entitled to vote who vote in Kosovo listed alphabetically and based on their municipality. The personal information that will be provided to for each voter are, surname, name, date of birth of his / her personal number, address and polling station where he / she is scheduled to vote, and b) All eligible voters that vote from abroad listed alphabetically. The personal information that will be provided to for each voter are: surname, name, date of birth of his / her personal number when possible and address. 3.8 Challenge and Confirmation Period means the time period between 54 days and 40 days before Election Day proclaimed by the President of Kosovo, in which voters can vote to oppose inaccuracies and omissions in the VL in accordance with procedures established by this electoral rule, and all applicable legal provisions. 3.9 Before the beginning of the Challenge and Confirmation Period, CEC will make VL available at the offices of the Municipal Election Commissions (MEC) in each municipality. MEC may designate additional locations to place VL, in accordance with the law on data protection, where necessary for you to give voters more likely, to have access to VL, in their municipality. 3.10 Voters List that is made ??available to the public during the Challenge and Confirmation shall not contain personal numbers of voters, also the Voters List which certified political entities and accredited observers are equipped with should be in electronic format and not should include personal number. 3.11 Before Election Day, CEC will certify VL which is established in accordance with the legal provisions in force, after the public has had the opportunity to challenge inaccuracies and omissions. Article 4 Process of Confirmation and Challenge 4.1 Any eligible voter, as specified in Article 5 of the Law on General Elections in the Republic of Kosovo, can access and challenge VL, or any inaccuracies or omissions in VL during the Challenge and Confirmation Period, every day working from Monday to Friday, from 09:00 to 12:00 and from 13:00 to 16:00 in the premises of Municipal Election Commission (MEC) in each municipality. 4.2 Accredited observers can observe Election Period Challenge and Confirmation in all locations where VL is available for viewing 4.3 Any eligible voter may review or challenge the VL, as defined in Section 4.1, provided that he / she should be identified as the MEC, presenting one of the following identification documents: a) Valid ID b) A valid travel document c) A valid passport d) Valid driver's license 4.4 Any eligible voter registered successfully for the program of voting abroad Kosovo, may review VL, the official website of the CEC, as provided in Section 4.1 of this Regulation. Successfully registered voters for the program of voting abroad Kosovo can challenge VL by presenting themselves with one of the following documents: a) Valid document with a photo, b) Certification of registration as a voter abroad Kosovo 4.5 A person who identifies himself with an identification document as provided in Article 4.3, and 4.4 can seek legal correction in the court of first instance, in accordance with the Law on General Elections in the Republic of Kosovo if he / she finds that the name of his / her not in VL. 4.6 A person who wishes to object to a name, to which he / she thinks should not be in VL, may seek legal correction in the court of first instance, in accordance with the Law on General Elections in the Republic of Kosovo. Article 5 Distribution of copies of Voters List 5.1 CEC Secretariat provides VL to each contact person for each certified political entity before the start of the challenge and confirmation period. 5.2 Any use of the VL by certified political entities that is inconsistent with the Code of Conduct for political parties and their supporters, or provisions of the law on protection of personal data represents a violation of these provisions. 5.3 Based on the request of individual accredited observers of the elections, the CEC/CEC Secretariat will provide copies of the VL during the election period. Article 6 Trial process If the case when a person seeking legal correction in accordance with Article 4.5 and 4.6 of this rule, and the court of first instance within his authority to decides that the person's request is in accordance with the legal provisions in force first degree court has the authority to order CEC to take remedial action on issues related to requirements dealing with VL. Article 7 Principles on personal data protection 7.1 Certified political entities and accredited observers will examine VL with the purpose of verifying the integrity of VL and can follow the period of challenge and confirmation. Based on the legislation for the protection of personal data, certified political entities and accredited observers will be considered the data controller. 7.2 Certified political entities and accredited observers are not allowed to: a) Create database of voters, or use the VL to update any basis of their data; b) Make a copy of VL or extract contrary to the purposes of section 7.1 of this rule. c) VL or transfer personal data from the VL to third parties; d) To use the VL-election campaign plan. 7.3 Accredited Observers are not allowed to: a) Assist the voter or the MEC staff in the identification of voters in VL or in preparing the application for submission to the court of first degree; b) Have access to the personal number of voters in VL which is used by the MEC during the challenge and confirmation period. 7.4 Certified political parties and accredited observers must destroy all copies of VL in their possession no later than 15 days after certification of the election results by the CEC. Article 8 Final and transitional provision With entry into force of this Regulation, Election Regulation with no 02/2008 on the Period of Challenge and Confirmation of Voters List of date 25.06.2009 is abolished Article 9 Entry into force This Regulation enters into force 02.07.2013.
